Terms of service

These Terms are an agreement between you and RaceZen Pty Ltd (ABN 90 698 675 946), a company incorporated in Australia ("RaceZen", "we", "us", "our"). They govern access to and use of RaceZen apps, websites, cloud services, race tools, tracks, replays, community features, and related services.

Acceptance and Eligibility

By creating an account, selecting the required agreement, or using RaceZen, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use the service.

You must be legally able to enter this agreement. If you are under the age at which you can enter this agreement independently, a parent or legal guardian must review and accept these Terms for you. If you use RaceZen for a club, event, team, school, or other organisation, you represent that you are authorised to act for it and to provide required notices and permissions to participants.

Accounts

Provide accurate account and event information, keep access methods secure, and promptly update information that affects safety, eligibility, or event administration. You are responsible for activity through your account except to the extent caused by RaceZen. Tell us promptly at privacy@racezen.app if you believe an account has been compromised.

The Service

RaceZen provides software for sailing race setup, registration, sign-on, start-line information, boat tracking, race-committee operations, scoring, results, safety aids, community groups, guardian access, tracks, replays, diagnostics, and related functions. Features and compatible devices may change. We may maintain, update, replace, or discontinue a feature, and will give reasonable notice when a material change adversely affects an active paid service.

Clubs and event organisers control their events, entries, official records, moderation decisions, and published results. Their additional event rules, notices, fees, refund terms, and privacy practices may apply separately.

Paid Services and Event Fees

Prices, billing period, currency, taxes, included features, renewal terms, and cancellation method will be shown before you buy a paid RaceZen service. A subscription renews only when the purchase screen states that it renews automatically and you authorise the purchase. You can cancel future renewals through the app store, payment provider, or account control identified at purchase; cancellation does not remove access already paid for through the end of the billing period.

Apple, Google, another app store, or an identified payment provider may process a purchase under its own terms. Event entry fees may be charged by the organising club or event rather than RaceZen. The purchase or entry screen identifies the seller and applicable terms. Refunds are provided when required by law and otherwise under the refund terms shown at purchase or by the responsible event organiser.

Your Content and Data Licence

You retain ownership of content and information you submit. You grant RaceZen a worldwide, non-exclusive, royalty-free licence to host, copy, store, process, transmit, format, display, and share that content and information as needed to operate, support, secure, and provide the features you select, and to develop, test, and improve RaceZen. This licence includes providing event records to the relevant organiser, displaying public event information, and sharing activity with groups, guardians, or link recipients you authorise.

RaceZen may retain sailing tracks and telemetry for as long as it needs them for those purposes. The licence over content that still identifies you ends when that content is deleted from the service, except for copies reasonably needed in backups, official event or safety records, information already shared to an organiser or group, and records RaceZen must retain by law.

RaceZen may create, retain, use, publish, and share indefinitely — including after your account is deleted — aggregated and de-identified data, statistics, benchmarks, research outputs, models, and promotional material derived from your content, provided they are not reasonably capable of identifying a person. This includes training and validating machine-learning models. Material that identifies you is used in promotion only with your consent, or where it is already published as part of a public event. Heart-rate and other health information and information read from Apple Health are never used for promotion or model training. Promotional material may show a public event as it was sailed, including images in which a junior sailor's boat and sail number appear alongside others; RaceZen does not feature, name, or make the subject of promotional material an identified junior sailor without a guardian grant.

Community Content and Conduct

You are responsible for content you post and must have the rights and permissions needed to submit it. Do not post unlawful, deceptive, infringing, abusive, harassing, threatening, hateful, sexually exploitative, dangerous, or privacy-invasive content. Do not impersonate others, expose another person's sensitive information without authority, manipulate event records, or use RaceZen to spam or defraud.

RaceZen and authorised club or event moderators may review reports, restrict visibility, remove content, block users, preserve evidence, or refer conduct to appropriate authorities when reasonably necessary to enforce these Terms, event rules, or law. You can report objectionable content or behaviour to privacy@racezen.app.

Acceptable Use

  • Use RaceZen lawfully and only for authorised sailing, club, event, coaching, spectator, or testing purposes.
  • Obtain required authority before entering information, creating a guardian link, or sharing content about another person, especially a junior sailor.
  • Do not probe, disrupt, overload, reverse engineer except where law permits, bypass access or safety controls, introduce malicious code, scrape restricted information, or use another person's credentials.
  • Do not use live positions or personal information to stalk, harm, discriminate against, or endanger a person.
  • Do not rely on RaceZen as the only source of safety, navigation, emergency, or official race information.

Sailing Is a Risk Sport

Sailing is a physical outdoor sport with real risk of injury, drowning, and damage to boats and equipment. Weather turns, boats capsize, gear breaks, and collisions happen. You sail at your own risk.

RaceZen makes software. We do not organise, run, supervise, or provide sailing, and we are not on the water with you. The decision to launch, to keep racing, and to come ashore is yours. On-water safety is the responsibility of you, your club, your race committee, and your event organiser.

Every Safety and Weather Feature Is an Aid

RaceZen's weather, wind, warnings, tracking, fleet and safety maps, capsize and unresponsive-boat indicators, sign-on and sign-off, and distress and rescue features are aids only. They help a person look. They do not decide, and they are not:

  • a safety system, head count, or muster;
  • a search-and-rescue, distress, or emergency service;
  • navigation equipment, or an official weather or warning service.

They can be wrong, late, incomplete, or unavailable. Weather, sensors, GNSS accuracy, communications, batteries, device placement, data entry, and human operation all affect them. A boat can be missing from a display for reasons that have nothing to do with the sailor — a flat battery, no mobile signal, a phone left ashore, or a phone underwater.

Never use RaceZen as your only means of raising an alarm, finding a person, or deciding whether it is safe to sail. In an emergency, call emergency services and tell your race committee.

Race committees, clubs, sailors, guardians, coaches, and officials remain responsible for safety, navigation, equipment, race conduct, eligibility, scoring, and official decisions. RaceZen data is advisory. An organiser may adopt it for an official race process such as scoring or results, but no adoption by anyone turns a RaceZen feature into a safety system.

Your Phone and Equipment

Using RaceZen means putting your own phone on a boat, on the water. You do that at your own risk. Where an event requires you to carry a device, that requirement is set by the organising authority in its notice of race, not by RaceZen, and it does not change who carries the risk.

Phones get wet, dropped, submerged, lost overboard, overheated, flattened, and broken, and bags and cases fail. RaceZen is not responsible for loss of or damage to your phone or other personal equipment arising from carrying or using it for sailing, and we do not repair, replace, or insure personal devices. If you would not accept losing a device, do not take it on the boat.

Where RaceZen or an event supplies you with a bag, case, or mount, your rights under the Australian Consumer Law in respect of that item are unaffected — but the phone inside it remains your risk.

RaceZen Intellectual Property

RaceZen and its software, designs, documentation, names, logos, and service content are owned by RaceZen or its licensors. Subject to these Terms, RaceZen gives you a limited, personal, non-exclusive, non-transferable, revocable right to use the service for its intended purpose. These Terms do not transfer any RaceZen intellectual-property rights.

Third-Party Services

RaceZen may connect to devices, app stores, payment services, maps, health platforms, club systems, or websites operated by others. Their terms and privacy practices apply to their services. RaceZen is not responsible for third-party services, but this does not limit rights that cannot lawfully be excluded.

Suspension, Termination, and Account Deletion

RaceZen may restrict, suspend, or terminate access when reasonably necessary to address unlawful, unsafe, fraudulent, abusive, or materially harmful conduct; protect people or the service; comply with law; or respond to a serious breach of these Terms. Where practical, we will provide notice and an opportunity to remedy the issue.

You may stop using RaceZen at any time and may delete your account using the available controls. Terms that by their nature should continue, including ownership, retained licences, payment obligations, disclaimers, liability limits, and dispute provisions, survive termination.

Consumer Rights, Disclaimers, and Liability

Nothing in these Terms excludes, restricts, or modifies a guarantee, condition, warranty, right, or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law. Where RaceZen supplies services to an Australian consumer and may lawfully limit a remedy, our liability is limited, at our option, to supplying the services again or paying the cost of having them supplied again.

Subject to those non-excludable rights, RaceZen is not liable for injury, death, or loss arising from sailing itself, from a decision made on or before going on the water, or from the acts or omissions of a club, event organiser, race committee, coach, or another sailor. We do not provide the sailing activity or on-water safety services.

Subject to those non-excludable rights, RaceZen is provided "as is" and "as available". We do not promise that every feature will be uninterrupted, error-free, or suitable for every event, device, or jurisdiction. To the extent permitted by law, RaceZen is not liable for indirect, incidental, special, exemplary, or consequential loss, or loss of profit, revenue, opportunity, goodwill, or data.

For all other liability arising from the service, RaceZen's total aggregate liability is limited to the greater of AUD 100 and the amount you paid RaceZen for the service giving rise to the claim during the 12 months before the event giving rise to liability. This cap does not apply to fraud, wilful misconduct, gross negligence, or liability that cannot lawfully be limited.

Changes to These Terms

We may update these Terms to reflect service, legal, safety, or operational changes. The date above identifies the current version. We will provide reasonable notice of material changes and request renewed acceptance where appropriate. Changes do not apply retroactively unless required by law or agreed with you.

Governing Law and Disputes

These Terms are governed by the laws of Victoria, Australia and the Commonwealth of Australia, without regard to conflict-of-law rules. Courts in Victoria have non-exclusive jurisdiction. Mandatory consumer protections and rights to bring a claim in your home jurisdiction remain unaffected.

Before starting formal proceedings, please contact us and give both parties a reasonable opportunity to resolve the dispute informally. This does not prevent either party from seeking urgent relief or using a consumer or privacy regulator.
